Welcome to MovingHelpers.org (“MovingHelpers,” “we,” “our,” or “us”). These Terms of Use govern your access to and use of the MovingHelpers website, applications, booking tools, communications, and related services (collectively, the “Platform”).

By accessing or using the Platform, creating an account, requesting a booking, listing services as a provider, or otherwise using MovingHelpers, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Marketplace role only

MovingHelpers operates an online marketplace that helps consumers connect with independent moving companies, movers, labor providers, and related service providers (“Providers”). MovingHelpers is not itself a moving company, carrier, broker of household goods, employer of Providers, or direct provider of moving labor or transportation services unless expressly stated otherwise in writing for a specific service.

Providers are independent businesses or individuals and are solely responsible for the services they offer, including their conduct, staffing, scheduling, tools, equipment, licensing, insurance, permits, legal compliance, pricing, and service quality.

We do not guarantee the quality, safety, legality, timing, suitability, or outcome of any Provider’s services, and we do not control how any Provider performs a job.

2. Eligibility to use the platform

You may use the Platform only if you are legally capable of entering into a binding contract under applicable law. By using the Platform, you represent and warrant that you meet this requirement.

The Platform is not directed to children, and minors may not use the Platform except through a parent or legal guardian who accepts these Terms on their behalf.

3. Accounts and account security

You may be required to create an account to access some Platform features. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must promptly notify us if you suspect unauthorized access or use of your account.

We may suspend, restrict, or terminate accounts that are inaccurate, fraudulent, abusive, unlawful, or otherwise violate these Terms.

4. Provider listings and no endorsement

Provider profiles, rates, descriptions, photos, service areas, reviews, availability, and other listing content may be supplied by Providers or generated from Platform activity. While we may moderate or format content, we do not guarantee that any listing content is complete, accurate, current, or free from error.

Displaying a Provider on the Platform does not constitute an endorsement, certification, recommendation, guarantee, or warranty by MovingHelpers.

5. Booking requests and provider acceptance

When a consumer submits a booking request, that request is an offer to purchase services from the selected Provider under the terms shown at checkout, subject to these Terms and any clearly disclosed booking details.

A booking may remain pending, draft, booked, rescheduled, canceled, refunded, disputed, or completed depending on Platform workflow and payment status. MovingHelpers may facilitate the request, but the underlying service relationship is between the consumer and the Provider.

Quotes and rates may depend on the details provided by the consumer, including addresses, distance, access conditions, stairs, elevators, heavy items, date, time, estimated hours, parking, and scope of work. If material details are inaccurate or incomplete, pricing and availability may change.

6. Pricing, booking fee, and payment authorization

By placing a booking, you authorize the charges disclosed during checkout, including the booking fee and any remaining balance that becomes due under the booking terms.

Unless otherwise stated on the Platform, MovingHelpers currently collects a booking fee at the time of booking to reserve the Provider, and the remaining balance may be charged after service completion and any applicable confirmation workflow.

You agree that you are responsible for all amounts associated with your booking, including applicable taxes, fees, adjustments approved through the Platform, chargebacks resulting from your conduct, and any lawful collection costs relating to unpaid amounts.

MovingHelpers is not a bank, money transmitter, escrow company, trustee, or fiduciary for your funds unless expressly required by applicable law. We use third-party payment processors, and payment processing is also subject to those providers’ terms and privacy practices.

7. Completion confirmation and payment release

The Platform may require one or more completion or confirmation steps before final payment is processed. If the Platform requests your confirmation and you provide it, you authorize release or collection of the applicable payment consistent with the booking terms shown on the Platform.

If you fail to respond to legitimate completion-related requests within a reasonable time, we may rely on available records, messages, timestamps, and other evidence in administering the booking workflow.

8. Cancellations, reschedules, and refunds

Cancellation, reschedule, and refund eligibility may depend on the booking status, timing before the scheduled move, whether the Provider accepted the request, whether service was already performed in whole or in part, and any specific refund rules displayed on the Platform.

If a cancellation or refund policy is displayed during booking, checkout, or within the booking workflow, that policy is incorporated into these Terms.

MovingHelpers may decide administrative refund or payment-routing issues for Platform charges, but service-performance disputes may still remain primarily between the consumer and the Provider.

9. Independent provider responsibility

Each Provider is solely responsible for its employees, contractors, helpers, vehicles, equipment, insurance, safety practices, legal compliance, and performance of services.

Consumers are solely responsible for providing accurate booking information, lawful instructions, safe site conditions to the extent under their control, and appropriate disclosure of known issues that may affect the move or service.

10. Disputes between consumers and providers

Any dispute regarding service quality, delays, breakage, injury, property damage, missing items, inaccurate listings, misrepresentations, cancellation consequences, or other service-related issues is primarily between the consumer and the Provider.

MovingHelpers may, but is not obligated to, facilitate communication, review records, or assist in resolving disputes. Any such assistance does not create responsibility for the underlying service dispute.

11. Reviews, feedback, and user content

Users may submit reviews, ratings, messages, photos, descriptions, and other content (“User Content”). You are solely responsible for your User Content and represent that it is truthful, lawful, non-infringing, and based on genuine experience where applicable.

You may not post false, defamatory, abusive, discriminatory, harassing, obscene, infringing, spammy, manipulated, or misleading content. We may moderate, remove, or refuse to publish User Content at our discretion.

By submitting User Content, you grant MovingHelpers a non-exclusive, worldwide, royalty-free license to host, display, reproduce, modify for formatting, and use that content in connection with operating, improving, promoting, and protecting the Platform.

12. Platform communications

SMS communications

By providing your phone number, you agree to receive text messages from MovingHelpers related to your account, provider profile, booking activity, and platform opportunities.

Message frequency varies depending on your activity and interactions with the platform. Message and data rates may apply.

You can opt out of SMS messages at any time by replying STOP. For assistance, reply HELP or contact us at support@movinghelpers.org.

Consent to receive SMS messages is not required to use the platform. We do not sell or share your phone number with third parties for marketing purposes.

You consent to receive communications from us related to your account, bookings, payments, customer support, product updates, safety notices, and operational messages by email, text message, phone call, push notification, or in-app message, as permitted by law and your settings.

Message and data rates may apply. Transactional and service-related messages may still be sent even if you opt out of certain promotional communications.

14. Suspension, removal, and termination

We may suspend or terminate access to the Platform, remove listings or content, cancel bookings, delay payouts, or take other protective action if we believe there has been fraud, abuse, policy violation, payment risk, legal exposure, safety risk, or conduct harmful to the Platform, users, or third parties.

15. Intellectual property

The Platform, including its software, design, layout, branding, text, graphics, logos, databases, and other content, is owned by or licensed to MovingHelpers and is protected by intellectual property laws.

Except for the limited right to use the Platform for its intended purpose, no license or other right is granted to you.

16. Third-party services and links

The Platform may contain links to or integrations with third-party services, including payment processors, maps, communications tools, analytics providers, and other vendors. MovingHelpers is not responsible for third-party services, content, availability, or policies.

17. Disclaimers

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVINGHELPERS DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, AND QUIET ENJOYMENT.

Without limiting the foregoing, MovingHelpers does not warrant that the Platform will be uninterrupted, error-free, secure, or that any Provider, consumer, booking, communication, or payment outcome will meet your expectations.

18. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVINGHELPERS AND ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR PROPERTY, ARISING OUT OF OR RELATED TO THE PLATFORM, BOOKINGS, PROVIDERS, CONSUMERS, OR SERVICES ARRANGED THROUGH THE PLATFORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF PLATFORM FEES ACTUALLY PAID TO MOVINGHELPERS IN CONNECTION WITH THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM, OR (B) $100.

19. Indemnification

You agree to defend, indemnify, and hold harmless MovingHelpers and its affiliates, owners, officers, directors, employees, contractors, agents, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Platform, your bookings, your services, your User Content, your violation of these Terms, or your violation of any law or third-party right.

20. Governing law and dispute resolution

These Terms are governed by the laws of the state designated by MovingHelpers in its principal business operations, without regard to conflict-of-law rules, except to the extent superseded by applicable federal law.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved in the courts designated by MovingHelpers, unless a separate arbitration agreement or legally required dispute procedure applies.

If you want mandatory arbitration and class action waiver language similar to larger marketplace operators, that should be added only after attorney review for enforceability in your target states.

21. Changes to these terms

We may update these Terms from time to time. Updated Terms become effective when posted unless a later effective date is stated. Your continued use of the Platform after updated Terms are posted constitutes acceptance of the updated Terms.
